Mediation in the Context of the IDEA: Considerations for Practice and Compliance

Special education disputes involve a unique intersection of legal mandates, educational practices, and the needs of children with disabilities and their families. Mediation in this context requires not only familiarity with conflict resolution theory and practice but also sensitivity to the regulatory framework of the Individuals with Disabilities Education Act (IDEA), the emotional dimensions of educational decision-making, and the importance of long-term relationships among all involved. This workshop examines the specialized role of mediation in resolving disagreements between families and the institutions that provide special education and related services to children and youth with disabilities. Participants will: explore the legal and policy framework guiding special education mediation; identify the distinct dynamics and challenges present in these disputes, including power imbalances and protecting the rights afforded families under Federal law; analyze strategies for fostering collaboration while maintaining neutrality and supporting informed decision-making; and practice skills for creating processes that are accessible, responsive, and child-centered. Through discussion, case study, and interactive exercises, the session highlights how mediators can adapt their practice to meet the particular needs of families, educators, and students. By the end of the workshop, participants will be equipped with insights and strategies to mediate effectively in this highly sensitive and impactful area of practice.
