Mediators serving under the Individuals with Disabilities Education Act (IDEA) occupy a unique role that demands not only strong facilitation skills but also a deep understanding of ethical responsibilities. This workshop provides an in-depth exploration of the ethical considerations that guide IDEA mediation, ensuring fairness, neutrality, and integrity throughout the process that is administered by a state agency both in and outside of the due process hearing system. Participants will examine common ethical dilemmas faced by IDEA mediators, including levels of directiveness and self-determination, ensuring parental rights in a system void of public scrutiny, addressing potential conflicts of interest, and navigating power imbalances between schools and families. The session will also highlight best practices for ethical decision making and provide tools to reinforce trust and credibility in the mediation process. By the end of this workshop, participants will have a clear framework for identifying and addressing ethical challenges in IDEA mediation. They will leave with greater confidence in upholding ethical standards, fostering trust among participants, and ensuring that mediation remains a fair, transparent, and effective process.
